3 good reasons to BUY UP now...

(1)September26.mobi is only 34 days away...

(2)Sept26.mobi is only 34 days away...

(3)BOFA.mobi is up, running, and being advertised...meaning the "un-knowing" Universe is about to enter the dotMobi World...

So today...I bought the following...

1-Irbid.mobi (2nd largest city in Jordan; after Amman.mobi, a premium)
2-WadiRum.mobi (a must tourist spot in Jordan; supports portfolio)
3-CluckUChicken.mobi (college campus eats)
4-CluckU (college campus eats)

More to come after some reflection...

RIC--if possible you may want to drop two of those and see if you can get your money back. Potential TM fights ahead....

But you don't think I can get a fast $500 on them? So I can buy more before Sept26 ?

Or, maybe even squeeze out a dev/hosting contract ? ...sort of Strong-Arming them, I know...but sometimes in business, it's done that way...you know?

Dude...good looking out for interest, though.

The chicken ones are playing with fire. Live Registered TM's. If you approach them the only strong-arming I would expect to see is them strong-arming you with a UDRP to get the names from you for free.

If you are talking about selling to another domainer, you would have to find someone who didn't know they were buying into a TM problem. If you are talking about selling to the TM owner, they may buy it for less than they would spend on legal fees, or they may be ****** about it and want to make you an example. I've heard of that happening before, but there is no way to know what they will do until it happens. I try to stay away from TM stuff because of all the lawyers, even though I am one--LOL!

If you are talking about selling to another domainer, you would have to find someone who didn't know they were buying into a TM problem.I think that raises another legal issue and one that could and would hold the seller liable.

First, knowingly regging names like this violates the registrars' TOS. Strike One.

Secondly, most transfer agreements (you know, that stuff we never read...:adore: all that legal mumbo Jumbo) contains statements in there about knowingly no conflicts regarding the sale or transfer. Strike Two.

What that tells me and the world that the seller could potentially face litigation from the buyer should the buyer be faced with having to surrender or lose the domain name. You damn well better believe I would go after the seller. But I don't place myself in either of these situations...as both a buyer and seller.

Thirdly, most big name companies pay for a service which automatically notifies them whenever any exact or similar domain name is registered any where in the world that may infringe on or violate their TM or SM. Think Microsoft, The Oscars, and eBay. If it is one of these (and tons more) it will be a few weeks after the reg but the emails and registered letters will be coming. STRIKE THREE!

If you are talking about selling to the TM owner, they may buy it for less than they would spend on legal fees, or they may be ****** about it and want to make you an example. I've heard of that happening before, but there is no way to know what they will do until it happens. Most forums are full of these "examples". What is most amusing is how ****** off the sellers are by losing the domain. Sometimes this is a great way to do business and it pays off.

But I think there is a equal number of instances where you have caught the attention of the wrong folks. After all, how many businesses out there are even aware of the .mobi extension at the moment? Obviously not many.

And right now that is what seems to be more and more in the WIPO cases at the moment. Why? Because of efforts to promote the domain by members of this forum and some other industry leaders. But the efforts are also made by those who contact the corporations to lure them into buying their own namesake. We, as MobiPhiles, appreciate the effort to bring awareness of the .mobi intiative to mainstream business use. But always keep in mind;

Someone in China was gleeful and happy...YIPPEE...I regged AAA.mobi.

If you do anything with them other than cancel the registrations, I would suggest something like that: approach them saying that you registered them for the company before someone with less-honorable intentions (ahem ahem) did. And say, "Oh, by the way, if you feel like giving me a whole meltdown full o' nuclear-flavored wings to say thanks, I certainly wouldn't complain..."

Good thinking. And if the TM owner ends up developing a mobi site because you brought this to their attention, that's just more good news for mobi--let us know if anything develops from this.
